KM Packaging Services Ltd is committed to ensuring that your privacy is protected. Any information given by you, and which allows you to be identified, when you visit our website or during the course of business with KM Packaging will only be used in accordance with this policy.

The purpose of this privacy notice, available to all via our website, aims to give you information on how we collect and process your personal data through your use of this website, including any data you may provide through this website when you sign up for our newsletter or submit an enquiry to us. This website is not intended for children and we do not knowingly collect data relating to children.

2. THE PERSONAL DATA WE COLLECT ABOUT YOU

Personal data, or personal information, means any information about an individual from which that person can be identified. You can find out more about personal data from the Information Commissioners Office.

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together follows:

  • Identity Data includes first and last name.
  • Contact Data includes company name and address, job title, email address, telephone number, geographical region and LinkedIn Profile URL.
  • Technical Data includes IP address
  • Profile Data includes what sector of the industry you work in (for example: food manufacturing, packaging converter/distributor, machine supplier, tray supplier) and what type of packaging you are interested in (for example: ready meals packaging, fresh produce packaging etc).

We will keep the minimum of personal data necessary to fulfil our course of business with you.

We do not collect any Special Categories of Personal Data about you nor do we collect any information about criminal convictions and offences.

If you fail to provide personal data

Where we need to collect your personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

3. HOW WE COLLECT YOUR PERSONAL DATA

Your personal data is collected directly from you, in a number of ways: 

  • You make an enquiry via our website.
  • You make an enquiry by phone, email or post.
  • You respond to an enquiry made by us.
  • You subscribe to our newsletter.
  • You give us your business card.

We only hold personal details of marketing targets who, by virtue of their business activity or employment, are believed to be genuine potential customers for our products. The legal ground for collecting, storing and processing the data of contacts and for them to receive marketing communications from KM, including employees of existing customers, is legitimate interest. Such legitimate interest extends throughout the supply chain to which we are part of – from production (i.e. machine supplier, food ingredients, food manufacturer) to distribution (retailer). 

KM will always balance the interest of individuals when collecting and processing personal data and will only ever use the individual’s data in ways they would reasonably expect.

4. HOW WE USE YOUR PERSONAL DATA

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

  • Performance of Contract this means processing your data where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract. This applies to employees of customers requesting orders or trial orders, and employees of suppliers with whom we have placed or are likely to place orders or trial orders. 
  • Legitimate Interest this means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the most secure experience and enable us to maintain and grow our business. This includes sending marketing email communications about our products and services. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law).
  • Comply with a legal or regulatory obligation this means processing your personal data where it is necessary for compliance with a legal or regulatory obligation that we are subject to.

Our overall objective is to be able to respond efficiently to your enquiries and/or orders, howsoever received; keep updated those people who have signed up to our newsletter or those we believe to have a legitimate interest in our products and services by virtue of their role; undertake occasional marketing research by email in order to improve our products and services.

We will always include in any email marketing communications our contact details and the ability for recipients to unsubscribe from future emails.

Change of purpose

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.

If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

Please note that we may process your personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

5. WHO WE SHARE YOUR PERSONAL DATA WITH

All personal data we hold will be processed by our staff in the UK. 

The personal data we collect and store will be entirely for the purposes described and will not be sold, distributed or leased to third parties unless we are required by law to do so.

We may have to share your personal data with the parties set out below for the purposes set out in the table in section 4 above.

Enquires relating to our C Range products will be passed to our partner Treetop Biopak for the purpose of responding and dealing with your enquiry. For further information on their privacy policy please click here

External Third Parties Services

Providers based in the UK who provide IT/System Administration Services/Softwares As A Service including:

  • A third -party email marketing service is used to distribute our marketing emails and therefore Identity, Contact and Profile data is held on their servers. For information on their data protection policy and safeguarding of your personal data please contact us.
  • Identity, Contact and Profile data of people who have either subscribed to our newsletter or submitted an enquiry using the online form on our website is held on the servers of our Web Design Agency. For information on their data protection and safeguarding of your personal data please contact us.
  • Our website hosting service holds Technical data (IP addresses) for security auditing purposes. For information on their log retention policy please contact us.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

Performance cookies: These help us understand how you are using our site. Performance cookies help us to analyse information like numbers of visitors to our website, measure usage and assess how well our advertising is working. We’ll use this information to tweak the performance of our website and improve the customer experience when shopping with us. These are the performance-related cookies that we currently use on our website:

  •  _gcl_au – this is related to AdWords and is used to analyse traffic that comes via an Ad.
  •  _ga - used to distinguish users.
  • _gid - used to distinguish users.
  • _gat_UA-40422176-1 - used to throttle request rate.

Functionality cookies: These cookies help us to offer extra functionality on our website. These are not strictly needed to be able to use the website, however they do enable features that will make it far easier to navigate and shop with us. We do not currently use any functionality cookies.

Targeting cookies: These cookies track the interest our visitors have in our products. We sometimes use this to understand what our customers are really interested in, so we can make sure we’re offering the right things. This means we can use browsing behaviour to create the most relevant banner adverts, only showing you products that you have already viewed or are similar to what you have already seen on our website. These banner adverts are displayed across a variety of other websites that customers may visit. This is called behavioural advertising and is tailored to each individual user, however cookie data is always anonymised and only stored temporarily. These banners will always feature an “i” icon which will supply information on the advertising network used and information on how to opt out if you wish. We do not currently use any targeting cookies.

We are committed to ensuring that your information is secure. We have a Data Protection regime in place to oversee the effective and secure processing of your personal data and as such we have suitable physical, electronic and managerial procedures in place to safeguard and secure the information we collect.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

9. DATA RETENTION

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

  • The right to request a copy of the personal data which we hold about you;
  • The right to request that we correct any personal data if it is found to be inaccurate or out of date;
  • The right to request your personal data is erased where it is no longer necessary to retain such data;
  • The right to withdraw your consent to the processing at any time, where consent was the lawful basis for processing your data;
  • The right to request that we provide you with your personal data and where possible, to transmit that data directly to another data controller, (known as the right to data portability), where applicable i.e. where our processing is based on consent or is necessary for the performance of our contract with you or where we process your data by automated means);
  • The right, where there is a dispute in relation to the accuracy or processing of your personal data, to request a restriction is placed on further processing;
  • The right to object to our processing of personal data, where applicable i.e. where processing is based on our legitimate interests (or in performance of a task in the public interest/exercise of official authority); direct marketing or processing for the purposes of scientific/historical research and statistics).

No fee required – with some exceptions

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable admin fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

What we may need from you

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time limit to respond

We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

Applicable law and our practices change over time. We may revise this policy by updating this page. We advise you to read our policy and check this page from time to time to ensure you are happy with any changes to our privacy policy. This policy was last modified on 09/08/2023.
